ZCore Social Terms of Use
ZCore Social creates technologies and services on web, app and blockchain platforms so that people can connect with each other, create groups, communities and grow their businesses. The Terms herein govern your use of ZCore Social and other products, features, applications, services, technologies and software that we offer (the ZCore Social Products or Products), except where we expressly state that other terms (and not these) apply. These Products are provided to each user (individual or legal entity who registers on the social network) by ZCore Social.
ZCore Social does not charge for use of the products and services covered by the Terms. Instead, companies, organizations and individuals pay us to show you advertisements for their products and services. When you use our Products, you agree that we can show you advertisements that we consider relevant to you and your interests. We use your personal data to help determine which ads to show.
We do not give or sell your personal data to advertisers and we do not share personally identifiable information (such as name, e-mail address or other contact information) with advertisers unless we have specific permission. Instead of providing information, advertisers tell us the types of audiences they want to be reached by their ads, and we show those ads to people who might be interested. We provide advertisers with reports on ad performance to help them understand how people are interacting with their content.
Our Data Policy explains how we collect and use your personal data to determine how some of the ads will be displayed and to provide all the other services described below. You can also review your privacy choices about how we use your data in your profile settings at any time.
1 – What services are provided:
Our mission is to give users the power to create communities, interact with interest groups and bring the world closer together. In order to further this mission, we provide users with the Products and services described below:
Provide a personalized experience for each user:
Your experience on ZCore Social is personal, not like anyone else's from posts, stories, events, ads and any other content you see on the platform. We use the data we have provided by you (for example, about the connections you make, the settings and choices you select, what you share and do inside and/or outside our Products and services) to personalize your experience.
We enable you to connect with the people and organizations you care about:
We help you find and connect with people, companies, groups, organizations and other entities you care about on the ZCore Social Products you use. We use the data you provide to make suggestions for you and others; for example, groups for you to join, pages for you to follow, programs for you to watch and people you might want to be friends with.
Allowing users to express and talk about themselves, their preferences and what is important to them:
There are many ways to communicate and express yourself with family, friends and acquaintances on ZCore Social, always cherishing what's important to you. For example, you can share profile updates, statuses, photos, videos, music and stories, all available on all the products you use on ZCore Social, tag friends, send messages to one friend or several people, create events or groups, or add content to your profile. We also continue to develop and explore new ways of using technology.
ZCore Social helps you get closer to content, products and services that may be of interest to you:
To this end, we display advertisements, offers and other sponsored content to you to help you discover content, products and services that are offered by the various companies, organizations and individuals that use ZCore Social and other ZCore Social Products.
Combat inappropriate, harmful and non-compliant conduct, protect and support our community:
People will only create communities on ZCore Social if they feel safe on the platform. To this end, we have advanced technical systems in place to detect inappropriate use of our Products, harmful conduct against others and situations where we may be able to help support or protect our community. If we identify or are notified of such content or conduct, we will take appropriate action, such as offering help, removing or blocking content, removing or blocking access to certain features, disabling an account or contacting authorities. We share data with other ZCore Social Companies when we detect inappropriate use or harmful conduct by someone who is using one of our Products in a contrary manner.
We are always working to develop new technologies to provide safe and functional products and services for everyone:
We develop and use advanced technologies so that people can use our Products safely, regardless of physical ability or geographic location.
Research ways to improve our services:
We will carry out user surveys to find out from the community about the performance of the social network, test its functionality, products and services. This includes analyzing the data we have about our users and understanding how people use our Products, for example, by conducting surveys and tests we can solve problems and develop new features.
Provide consistent and seamless experiences across ZCore Social Companies' Products:
Our Products will help you find and connect with people, groups, companies, organizations and other entities that you consider important.
Enable global access to our services:
To operate our services globally, we need to store and distribute content and data on our servers and systems around the world, including outside your country of residence. This infrastructure can only be operated or controlled by ZCore Social and the ZCore Network companies.
Your commitment to ZCore Social and our community
We provide these services to you and others under the same terms of use in order to help further our mission. In return, we need you to make the commitments of good conduct highlighted below:
2. Who can use ZCore Social
Users take responsibility for their own opinions and actions, so our community becomes safer and more responsible. Therefore, each user must
Use the same name they use in their daily life and on their legal documents.
Provide accurate and truthful information about themselves.
Each User may only create one account (their own) and use their timeline for personal purposes.
You may not share your password, give access to your ZCore Social account to a third party, or transfer your account to another person (without our permission).
We seek to bring ZCore Social to all people and countries broadly, but you may not use it if:
You are under 13 (or under the minimum legal age in your country to use our Products and services).
You have been convicted of a sexual offense.
In cases where we have previously disabled your account for violations of our Terms or Policies.
You may also not use if you are prohibited from receiving our products, services or software under the laws applicable in your country.
3. What you can share and do on ZCore Social:
ZCore Social is a community so that people can express themselves and share content that is important to them, however, we need to preserve good customs and the rights of all, so we have to maintain the safety and well-being of other users or the integrity of our community. In this sense, you agree not to adopt the behavior described below (nor to facilitate or support others in doing so):
3.1 - You may not use our Products to do or share anything:
That violates these Terms, our Standards, the Community Standards and other terms and policies applicable to your use of ZCore Social.
That is unlawful, deceptive, biased, discriminatory or fraudulent.
That infringes or violates the rights of others, including intellectual property rights.
3.2 -You may not upload viruses or malicious code, or do anything to disable, overburden or affect the proper functioning or appearance of ZCore Social products.
3.3 - You may not collect or access data from our Products using automated means (without ZCore Social's prior permission) or attempt to access data that you do not have permission to do so.
ZCore Social may at any time remove or restrict access to content that violates these provisions. If we remove content that you have posted or shared for violating our Community Standards, we will notify you and explain your options for requesting a review of the content, unless you seriously or repeatedly violate these Terms or do something that could expose ZCore Social or others to legal liability; harm the community and other users; compromise or interfere with the functionality or operation of any of our services, systems or Products; at a time when we are restricted due to technical limitations; or when we are prohibited or limited from doing so for legal reasons. To help maintain the community, we encourage all users to report content or conduct that they believe violates their rights (including intellectual property rights) or our terms and policies.
4. The permissions you grant us:
ZCore Social needs certain permissions from you in order to provide you with our services and products:
Permission to use the content you create and share: the content you upload or share, such as photos, videos and music, may be protected by intellectual property laws. You own the intellectual property rights (such as copyright or trademarks) in the content you create and share on ZCore Social. Nothing in these Terms takes away the rights you have in your own content. You are free to share your content with anyone. However, in order to make our services and products available to you, we need you to grant us certain legal permissions (which we will refer to as a “user license”) to use that content. This is only for the purposes of providing and improving our Products and services as described above. Specifically, when you upload, post or share content protected by intellectual property rights on our Products and or in connection with our Products, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to host, use, distribute, modify, transmit, copy, publicly perform or display, translate and create derivative works from your content (consistent with your privacy and application settings). This means, for example, that if you share a photo on ZCore Social, you give us permission to store it, copy it and share it with others (again, consistent with your settings). The license will be terminated when the content is deleted from our systems. You can delete your content individually or all at once by deleting your account. When you delete your content, it will no longer be visible to other users. However, it may continue to exist elsewhere on our systems when:
Immediate deletion is not possible due to technical limitations (in this case your content will be deleted within a maximum of 90 days from the date you deleted it);
If the content has been used by other people in accordance with this license, and they have not deleted it (in this case, the license will continue to apply until that content is deleted); or
Immediate deletion would restrict ZCore Social's ability to:
Investigate or identify illegal conduct or violations of ZCore Social's terms and policies (for example, to identify or investigate misuse of Products or the systems);
Comply with legal obligations regarding the preservation of evidence; or
To comply with a request from a judicial or administrative authority, law enforcement or government agency;
In this case, the content will only be preserved for as long as necessary for the purposes for which it was retained (the duration of its retention will vary according to the case). In each of the above cases, the license will be maintained until the content has been completely deleted.
You allow us to use your name, profile picture and information about your actions with advertisements and sponsored content, information about actions taken on ZCore Social, next to or related to advertisements, offers and other sponsored content that we display on our Products, without paying you any remuneration. As an example, we may show your friends that you are interested in an advertised event or that you have liked a Page advertised by one of the brands that has paid us to display advertisements on ZCore Social. Ads of this nature can only be seen by people who have your permission to see the actions you take on ZCore Social.
Permission to update the software you use or download: if you download or use our software, you give us permission to download and install updates to the software when available.
5. Limits on the use of our intellectual property
If you use content protected by intellectual property rights that we own and make available on our Products (such as images, designs, videos or sounds provided by ZCore Social that you add to content you create or share), we retain all rights to that content (except for content you own). You may only use our copyrights or trademarks (or any similar marks) as expressly authorized by our Trademark Usage Guidelines or with our prior written permission. You must obtain our written permission (or permission under an open source license) to modify, create similar or derivative works of, decompile or otherwise attempt to extract the source code of our systems.
6. Additional provisions:
6.1. Updating our terms of use
We continually work to create and improve our services and develop new features in order to make our Products better for you and our entire community. Accordingly, we may update these Terms from time to time so that they accurately reflect our services and practices. We will only make changes when necessary and for the inclusion of services that require such inclusion, but only if the changes are reasonable and take into account the interests of users. You will be notified (for example, by email or through our Products) at least 30 days before we change these Terms and will have the opportunity to review such changes before they take effect, unless required by law. Once the updated Terms take effect, you will be bound by them if you continue to use our Products and services.
ZCore Social expects you to continue using our products and services, but if you do not agree to our updated Terms and no longer wish to be part of the ZCore Social community, you may delete your account at any time.
6.2. Account suspension or termination
ZCore Social was created so that users can feel welcome and safe to communicate, express and share their thoughts and ideas. If we believe that you have manifestly, seriously or repeatedly violated our Terms or Policies, including the Community Standards in particular, we may provisionally or permanently suspend or disable access to your account. We may also suspend or disable your account if you repeatedly violate someone else's intellectual property rights or when we are required to do so for legal reasons. If ZCore Social takes these actions, we will notify you and explain your options for requesting a review, unless doing so would expose us or others to legal liability; harm our community of users; compromise or interfere with the integrity or operation of any of our services, fonts or Products; when we are restricted due to technical limitations; or when we are prohibited from doing so for legal reasons. If you delete or ZCore Social deactivates your account, these Terms will terminate as an agreement between you and us, but the following provisions will remain in effect: 4, 6.1 and 6.2.
6.3. Limits of liability
ZCore Social works continuously to provide the best possible Products and Services and to specify clear and equal guidelines for all users. All Products and Services, however, are provided “as received by the user on the system”, and we make no warranty that they will always be secure, or error-free, or that they will operate without interruption, delay or imperfection. Also to the extent permitted by law, we DISCLAIM ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY FIT FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT”.
We will not control or direct what users and third parties do or say and we are not responsible for their conduct (whether online or offline) or for any content they share (including offensive, inappropriate, obscene, illegal or objectionable content). We cannot predict when problems might occur with our Products. Accordingly, our liability is limited to the maximum extent permitted by applicable law, and under no circumstances will we be liable or jointly liable to you for any loss of profits, revenue, information or data, or for any special, direct or indirect, exemplary, punitive or incidental damages arising out of or relating to these Terms or the ZCore Social Products, even if we have been advised of the possibility of such damages.
6.4. Any Disputes:
In these terms we try to provide clear rules in order to limit or even avoid conflicts between users and ZCore Social. However, in the event of a conflict, it is useful to know in advance where it can be resolved and which laws apply in each case. If you are a consumer, the laws of the country in which you reside apply to any claim, cause of action or dispute you have against ZCore Social arising out of or in connection with these Terms of Use or the Products, and you may resolve your claim in any court of competent jurisdiction in that country. In all other cases, you agree that your claim shall be resolved exclusively in the Court of Brazil, with venue in the City of Belém, State of Pará. You also agree to submit to the personal jurisdiction of any such court for the purpose of litigating any claim and that the laws of Brazil will govern these Terms and any claim, without regard to conflict of laws provisions.
6.5. Other Terms
6.5.1 - These Terms constitute and guide an integral agreement between the User and ZCore Social regarding their use of our Products.
6.5.2 - The Products we make available and offer are also governed by supplementary terms. If you use any of these Products, supplementary terms will be made available and will form part of our agreement with you. As an example, if you use our Products for commercial or business purposes, such as buying ads, selling products, developing applications, managing a group or Page for your company or using our measurement services, you must agree to our Commercial Terms. If you post or share content with music, you must agree to our Music Guidelines. If any supplementary terms conflict with these Terms, the supplementary terms shall prevail to the extent of the conflict.
6.5.3 - If any part of these Terms is held to be unenforceable in a particular case, the remaining part will remain in full force and effect. If we fail to enforce any part of these Terms, this will not be considered a waiver. Any changes to or waivers of these Terms must be made in writing and signed by ZCore Social.
6.5.4 – You may not transfer any of your rights or obligations under these Terms to any other user without our consent.
6.5.5 – You may designate a person (called an Heir) to administer your account if you are unable to administer it yourself, in cases of death called “in memory of”. Only your Heir contact or a person you have identified in a valid will or similar document that expresses clear consent to disclose your content in the event of death or incapacity may seek disclosure of your account after it has been transformed into an “in memory” account.
6.5.6 - These Terms do not grant any rights to third party beneficiaries. All rights and obligations under these Terms are freely transferable by us in the event of a merger, demerger, acquisition, sale or purchase of assets or by operation of law or otherwise.
6.5.7 –The User should be aware that ZCore Social may have to change the username of their account in certain circumstances (for example, if another person claims such a username and we understand that you have no relation to the name you use in your daily life). You will be notified in advance and given an explanation of the change if we have to make it.
6.5.8 – ZCore Social will always appreciate receiving your feedback and other suggestions about the products and services. However, please be aware that we may use them without any restriction or obligation to compensate you, and we have no duty to keep them confidential.
6.5.9 – ZCore Social reserves all rights not expressly granted to the User.
